This Privacy Policy explains how Agere Sciences (“Agere Sciences,” “we,” “us,” or “our”) collects, uses, shares, and protects personal information when you visit our websites, use our software or services, communicate with us, or otherwise interact with us (collectively, the “Services”).

  • Payment Data: limited billing details (processed via payment processors; we do not store full payment card numbers).

  • Prospect/Lead Data: business contact details from you, your organization, or reputable B2B sources.

    Sources: directly from you, automatically via cookies and similar tech, from your organization, service providers (analytics, marketing, payment, shipping), and publicly available B2B sources.

  • Inputs & Outputs. Your prompts, files, and usage may be processed to generate outputs. AI outputs can be inaccurate—it is your responsibility to verify important results.

  • Providers. We may use third-party AI vendors under contract. We take reasonable measures to protect your data consistent with this Policy.

  • Training. We do not allow third-party AI vendors to use your content to train their generalized models without our instructions or consent. We may use de-identified or aggregated data to improve our features.

4) How We Share Information

In certain circumstances, we share information with:

  • Service Providers/Processors: hosting, cloud, analytics, payment, shipping, communications, AI, security, and marketing partners (only as needed to perform services for us).

  • Our Corporate Group,Affiliates and Professional Advisors.

  • Legal & Compliance: to comply with law, protect rights, safety, prevent fraud, to enforce any applicable Terms of Service, and/or to protect or defend the Services, our rights, the rights of our users, or others.

  • Business Transfers: in connection with a merger, acquisition, financing, or sale of assets.

We do not sell personal information for money. We may “share” limited identifiers/online activity with advertising or analytics partners for cross-context behavioral advertising where permitted by law. You can opt out (see Section 8).

We use cookies, pixels, and similar technologies to operate the site, remember preferences, measure performance, and (where permitted) for analytics/ads. We may permit third parties and service providers to use cookies, pixels, and similar technologies to better tailor the Services.

  • We honor Global Privacy Control (GPC) signals for applicable opt-outs where required by law.

  • “Do Not Track” (DNT) is not standardized; we do not respond to DNT signals.

We use reasonable technical and organizational safeguards designed to protect personal information. No method of transmission or storage is 100% secure. Do not use insecure channels to communicate with us.

We retain information as long as needed for the purposes above, to comply with legal obligations, resolve disputes, and enforce agreements.

  • Cookie/Ads Preferences: Use your browser settings and GPC; contact us to request an ads opt-out.

  • “Do Not Sell or Share” (CA/CPRA): If you are a California resident, you may opt out of “sharing” for cross-context behavioral advertising by emailing [email protected] with subject “Do Not Sell or Share,” or by sending a GPC signal (honored where required).

9) Your Rights (U.S. State Laws, incl. CA/CPRA)

Depending on your state, you may have the right to:

  • Know/Access the categories and specific pieces of personal information we collected about you.

  • Delete personal information we collected from you.

  • Correct inaccurate personal information.

  • Opt-out of sales/sharing/targeted advertising and certain profiling.

  • Non-discrimination for exercising your rights.

How to exercise: email [email protected] and specify your request. We will verify your identity and respond as required by law. You may use an authorized agent with proper authorization.

Notice at Collection (CA): We collect the categories listed in Section 1 for the purposes in Section 2; we retain data as described in Section 7. We may “share” limited identifiers/online activity for cross-context behavioral advertising; you may opt out as above. We do not use or disclose sensitive personal information for purposes requiring a right to limit under CPRA.

10) EEA/UK/Swiss Residents (GDPR)

If you are in the EEA/UK/Switzerland, Agere Sciences is the controller of your personal data processed via the Services.

  • Legal bases: performance of a contract; legitimate interests (e.g., security, improvement, marketing to business contacts); consent (where required); and compliance with legal obligations.

  • Rights: access, rectification, erasure, restriction, portability, and objection; withdraw consent where we rely on consent.

  • Transfers: we may transfer data to countries without equivalent protection (e.g., U.S.) using appropriate safeguards (e.g., Standard Contractual Clauses).

11) Children’s Privacy

The Services are not directed to children under 183, and we do not knowingly collect personal information from them. If we learn we have, we will delete it. As of the effective date of this Privacy Policy, we do not have actual knowledge that we collect, share, or sell (as those terms are defined by applicable law) personal information from individuals under 18 years of age.

Our Services may contain links to third-party sites or services. We are not responsible for their privacy practices or content.

We may update this Policy from time to time. The “Effective” date above reflects the latest version. Material changes will be posted with an updated effective date
